These Terms and Conditions (“Terms”) govern the sale of a product (“Product”) by Sam Collett TA Sitesi (herein referred to as “Sitesi”) (“Seller”) to the customer (“Buyer”). By purchasing the Product, the Buyer agrees to be bound by these Terms.

1) Definitions

Product: The item sold under this agreement. 

Buyer: The individual or entity purchasing the Product. 

Seller: Sitesi, whose office is 1a Norfolk
Way, Moorgate, Rotherham, South Yorkshire, United Kingdom, S60 3BS.

2) Orders and Payment 

All orders are subject to acceptance by Sitesi, which reserves the right to reject or cancel any order at its discretion.

Payment must be made in full before dispatch unless otherwise agreed in writing. Payment methods accepted include bank transfer, credit card, and approved finance agreements.

Prices are subject to change without notice, except where a formal quotation has been provided and remains valid within the specified timeframe. Quotes are valid for 30 days unless otherwise stated.

Sitesi reserves the right to refuse or cancel orders due to pricing errors, stock shortages, or suspected fraudulent transactions.

2) Product And Setup

The Product is sold as a item. All representations, images, and descriptions are for illustrative purposes only.

If applicable, setup instructions will be provided. The Seller may offer setup services for an additional fee, which must be agreed in writing prior to delivery.

3) Delivery And Acceptance

Delivery will be arranged to the address specified by the Buyer.

Risk passes to the Buyer upon delivery, unless otherwise agreed in writing.

The Product is covered by transit insurance arranged by the Seller, limited to the purchase value.

The Buyer must inspect the Product upon delivery and sign an Acceptance Form acknowledging:

  • Receipt of the Product in good condition;
  • No visible defects or damage;
  • Correct delivery in accordance with the order.
  • Any issues must be noted in writing on the Acceptance Form at the time of delivery
  • Failure to sign the Acceptance Form may delay or invalidate warranty claims or liability investigations.
4) Warranty

The Equipment is covered by the manufacturer’s warranty, where applicable. Warranty durations vary and are outlined in the purchase agreement.

Sitesi does not provide additional warranties unless explicitly stated in writing. Extended warranties may be available at an additional cost.

The warranty does not cover:

  • Damage resulting from misuse, neglect, accidents, or unauthorised modifications;
  • Cosmetic damage;
  • Normal wear and tear.

Warranty claims must be submitted in writing with supporting evidence. The Seller reserves the right to inspect and assess all claims before issuing any remedy, which may include repair, replacement, or refund.

5) Limitation Of Liability

 To the fullest extent permitted by law, the Seller shall not be liable for any:

  • Indirect, special, incidental, or consequential losses;
  • Loss of profits, revenue, or business opportunity;
  • Personal injury or property damage caused by misuse or improper setup.

The Seller’s total liability shall not exceed the amount paid by the Buyer for the Product.

6) Illegal Use

The Buyer agrees and acknowledges that the Product is not to be used for any unlawful or prohibited purpose.

The Seller accepts no liability for any direct or indirect consequences arising from the illegal use or misuse of the Product by the Buyer or any third party.

It is the sole responsibility of the Buyer to ensure that the use of the Product complies with all applicable laws and regulations in their jurisdiction.

7) Delivery Issues And Insurance

The Seller shall insure the Product during transit to the Buyer. Insurance shall cover loss, theft, or damage in transit up to the purchase price.

If the Product is lost, stolen, or damaged in transit, the Buyer must notify the Seller within 48 hours of the scheduled delivery date.

The Buyer agrees to cooperate with the Seller and its insurers in any claims process.

Delays in delivery caused by events beyond the Seller’s reasonable control (including but not limited to strikes, customs delays, and force majeure) shall not constitute grounds for cancellation, refund, or further liability.

8) Governing Law And Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

Any disputes arising out of or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Definitions 1.1 “Company” refers to Sam Collett TA Sitesi, the seller of IT equipment, including hardware, software, and associated services. 1.2 “Customer” refers to the purchaser of IT equipment from Sitesi, whether an individual, business, or organisation. 1.3 “Equipment” refers to IT hardware, software, accessories, and related products supplied by Sitesi, including refurbished and pre-owned items. 1.4 “Agreement” refers to these Terms and Conditions, including any order confirmations, invoices, warranties, and additional agreements. 1.5 “Business Days” means any day other than a weekend or public holiday in the United Kingdom. 1.6 “Third-Party Supplier” refers to external manufacturers or distributors involved in supplying the Equipment.

2. Orders and Payment 2.1 All orders are subject to acceptance by Sitesi, which reserves the right to reject or cancel any order at its discretion. 2.2 Payment must be made in full before dispatch unless otherwise agreed in writing. Quotes are valid for 30 days unless otherwise stated. 2.4 Sitesi reserves the right to refuse or cancel orders due to pricing errors, stock shortages, or suspected fraudulent transactions. 2.5 Late payments may be subject to interest charges in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

3. Delivery 3.1 Delivery timescales are estimates and not guarantees. Sitesi shall not be liable for delays beyond its control, including courier issues or customs clearance. 3.2 Risk of loss or damage passes to the Customer upon delivery. The Customer is responsible for ensuring a secure and accessible delivery location. 3.3 The Customer must inspect the Equipment upon receipt and report any damage or discrepancies within 48 hours. Failure to report issues within this timeframe may void claims. 3.4 If a delivery is delayed due to Customer inaction or incorrect details, additional charges may apply for re-delivery.

4. Warranty and Returns 4.1 The Equipment is covered by the manufacturer’s warranty, where applicable. Warranty durations vary and are outlined in the purchase agreement. 4.2 Sitesi does not provide additional warranties unless explicitly stated in writing. Extended warranties may be available at an additional cost. 4.3 Faulty or defective Equipment must be reported within the warranty period and returned in accordance with Sitesi’s return process. Any tampering or unauthorised repairs may void the warranty. 4.4 Sitesi reserves the right to repair, replace, or refund at its discretion. Refunds are only issued in cases where repair or replacement is not feasible. 4.5 Returns for non-faulty Equipment may be subject to a restocking fee and must be in original packaging, unused, and in resalable condition. Software, digital licences, and consumables (e.g., ink cartridges) are non-refundable. 4.6 Sitesi is not responsible for warranty coverage on used or refurbished Equipment unless explicitly stated.

5. Liability 5.1 Sitesi shall not be liable for indirect, consequential, or incidental damages arising from the use of the Equipment, including but not limited to business loss, revenue loss, or reputational damage. 5.2 The maximum liability of Sitesi shall not exceed the amount paid by the Customer for the Equipment. 5.3 Sitesi is not responsible for data loss, business interruptions, or any damage caused by software, hardware malfunctions, or improper use of the Equipment. 5.4 The Customer agrees to indemnify Sitesi against any claims arising from misuse, modifications, or unauthorised resale of the Equipment.

6. Data Security and Privacy 6.1 The Customer is responsible for data security and backup before returning any Equipment. Sitesi accepts no liability for data loss during returns, repairs, or replacements. 6.2 Sitesi is not responsible for any data loss that may occur during repairs or replacements. It is recommended that the Customer securely erases all data before sending Equipment for service. 6.3 Personal data provided by the Customer shall be processed in accordance with Sitesi’s Privacy Policy. Sitesi does not sell or share Customer data with unauthorised third parties. 6.4 Customers should ensure compliance with GDPR and other applicable data protection regulations when handling personal data stored on the Equipment.

7. Software and Licensing 7.1 Any software provided with the Equipment is subject to the licensing terms of the software provider. The Customer must comply with all applicable software licensing agreements. 7.2 Sitesi is not responsible for software compatibility or licensing compliance, nor does it offer refunds on software once activated. 7.3 If software is pre-installed, the Customer is responsible for registering and activating the license where required.

8. Force Majeure 8.1 Sitesi shall not be liable for any failure or delay in performing obligations due to circumstances beyond its control, including but not limited to natural disasters, strikes, supply chain disruptions, cyber-attacks, pandemics, or government regulations.

9. Governing Law and Dispute Resolution 9.1 This Agreement shall be governed by and construed in accordance with the laws of England and Wales. 9.2 Any disputes shall be resolved through negotiation in good faith. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. 9.3 Customers agree to notify Sitesi in writing of any dispute and allow reasonable time for resolution before initiating legal proceedings.

10. General Provisions 10.1 The Customer agrees to comply with all applicable laws and regulations related to the purchase and use of the Equipment. 10.2 Any amendments to this Agreement must be in writing and agreed upon by both parties. 10.3 If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. 10.4 Sitesi reserves the right to modify these Terms and Conditions at any time, with notice provided to Customers where necessary.
